SOME IMPORTANT STEPS AND REQUIREMENT FOR THE REGISTRATION OF YOUR CHURCH

The followings are required by the Corporate Affair Commission before you can register your Church Name:

Availability and Reservation of name form.

Procurement and completion of Application form.

Publication of notice in two Daily Newspapers; one National and one Local Newspaper widely circulated in the area where the Church is based.

A formal letter of Application signed by the Chairman, Secretary or Application's solicitor

Minute of the meeting where the Trustees were Appointed, stating the list of members in attendance

2 Copies of the Church Constitution.

2 Passport – sized photographs of each Trustee.

Declaration form sworn to at the High court(also receipt from the High Court).
The Common Seal of the Church.

Payment of the Filling Fee

WHY DO YOU NEED TO REGISTER YOUR CHURCH?

Church registration have been overlooked by some Pastors. Perhaps, they do not know the implications of this little negligence. That the Nigeria constitution allow for freedom of fellowship does not overrule necessity of church registration.
Even, the Agents (A Lawyer, A Chartered Accountant, A Chartered Secretary ) who are to stand as the middle personnel between the Commission and the Pastor, are not helping the matter, some among these agents charge so high that even a pastor will think that to Incorporate his fellowship is a task which can not be carried out. Meanwhile, the Commission is not charging more than N37,000 for official filling of such exercise.
However, Pastors this is not an excuse. Your Church must be Incorporated. There is a law which say “ a freedom of fellowship” is encourage and there is another law which call for “the registration of such fellowship”. Let me quickly stress at this point by bringing to your notice that the body responsibly for this exercise is known as “Corporate Affair Commission”- CAC. The commission can only register an “Incorporated Trustees”.
In another word, only the appointed, selected or the elected Trustees can be Registered and not a Church Name as wrongly believed and pronounced by many people.

A Trustee is a custodian of a church property
A Trustee is elected, selected or appointed by either the church, the council of ministers or the founder of the church/fellowship

Now, let us quickly look at some reasons why you need to register your Church.
  • Under Company and Allied Matter Act 1990, the Church must be registered.
  • A Church is recognize as a public property.
  • A Church cannot be inherited either by the founder, his family members or his personal representatives
  • Registered Churches in Nigeria is protected by the Nigerian Constitution. The Constitution allows for freedom of fellowship/worship or association.
  • If your Church is not registered, then you're not recognize by the government.
  • Unregistered Church cannot sue anybody for any reason.
  • God forbid that your Church is moles, duped or abused by the Omo-onile, you can not take any legal step against them.
  • God forbid anything bad happen during your Church programmes which you need to take a legal action. If your Church is not registered all your legal actions becomes illegal in the eyes of the law.
  • If you don't registered your Church you cannot own any property in the name of the Church.
  • The law enforcement agent can take any unregistered Church for a ride.
  • You can be denied of your rights and privileges if you're not registered
  • Unregistered Church has no say in the community when it comes to a legitimate issues.
